These Terms and Conditions apply to visitors of the DocMR (“we” , “us”, or “our”) website located at www.docmr.net (our “Website”) as well as the registered users (“you” or “your” ) of our DocMR ® technology Services (our “Services”) accessible through the website. The Terms and Conditions serve as an Agreement between DocMR and any registered user who starts using DocMR Services.
DocMR® is a cloud-based electronic medical records software designed to cater to the specific requirements of individual healthcare professionals as well as small to medium-sized medical and dental practices. Our software assists healthcare professionals in managing their clinics and streamlining their workflow, by offering them features such as appointment scheduling, patient record storage, test result uploads, and payment management.
Prior to accessing our Website and/or using the Services provided by DocMR, we kindly ask website visitors and registered users to thoroughly review the following Terms and Conditions, which delineate the regulations, commitments, and duties they consent to adhere to when accessing our Website or subscribing to our Services.
You must be at least 18 years of age to access the Website or use the Services.
Upon accessing our Website or using our Services, you acknowledge that you have comprehensively read, understood, and agreed to be bound by these Terms and Conditions. If you do not agree with any part of these Terms and Conditions, then you may not access the Website or use any of its Services.
1. Accessing Our Services
The Services provided by us are our property. We grant you a non-exclusive, non-transferrable right to access and use the Services which include any written materials including user guides, documentation and training materials provided by us. The Services provided by DocMR are intended for use within Lebanon and are not intended for distribution to or use by any person or entity in any jurisdiction or country where such distribution or use would be contrary to law or regulation or which would subject us to any registration requirement within such jurisdiction or country. Accordingly, those persons who choose to use the Services provided by DocMR from other locations do so on their own initiative and are solely responsible for compliance with local laws, if and to the extent local laws are applicable.
2. User Guidelines
DocMR allows you to store various types of information, including but not limited to: medical or dental clinic general details, scheduled appointments, patient contact information, medical records, progress notes, uploaded test and imaging results, detailed procedure lists, payment information and any other sensitive data that you, as a registered user, decide to add to your account. To help us ensure utmost data security, it is imperative that registered users follow the User Guidelines listed below.
As a registered user of DocMR Services, you agree that you will follow these guidelines:
-All registration information you submit will be true, accurate, current, and complete
-You will maintain the accuracy of such information and promptly update such registration information as necessary
-You have the legal capacity and you agree to comply with Terms and Conditions
-You will not access the Services through automated or non-human means, whether through a bot, script or otherwise
-You will not use the Services for any illegal or unauthorized purpose
-You will not share your Credentials with anyone else. Credentials include any username, password, PIN, or any other form of unique identifier that we provide you with. You will be responsible of keeping your password strong and will be strongly advised to use two-factor authentication to bolster security.
-You should immediately notify us if your credentials have been stolen or compromised. You are responsible for all activities that occur under your Credentials until you have properly notified us that your Credentials have been stolen or compromised.
-You will not attempt to access DocMR by using any account that was not personally assigned to you by us
-You will not copy or redistribute DocMR content (including but not limited to software features or any documentation and training materials provided by us) and make it public if it is not already
-You will not share your patients’ data with anyone except by adding them as a registered user to your clinic account.
-You will not try to sell your access to DocMR to other people or companies
DocMR reserves the right to:
-Suspend or terminate your access to our Services with no refund at any time in case these user guidelines are not followed.
-Refuse service to anyone
DocMR is not liable by any means for any damage caused by registered users to their patients, to other registered users or to third parties.
3. SUBSCRIPTION AGREEMENT
3. a. Scheduling a Demo:
Upon requesting a demo through our website, you will have the opportunity to schedule a meeting with us, during which we will showcase the key features of DocMR and address any inquiries you may have.
3. b. Free Trial:
Following the demo meeting, you will have access to a free 14-day trial period if you wish to try the Services offered by DocMR before committing to a monthly or annual subscription. During this trial period, no charges will be applied. At the end of the trial period, your subscription will be suspended unless you opt to upgrade to a paid version.
3. c. Subscription Activation:
Provided that you agree with the Terms and Conditions, once your payment for a monthly or a yearly subscription is successfully processed, we will promptly set up your account and provide you with unique credentials so that you can access DocMR Services. You will receive one complimentary virtual training session of a maximum of 2 hours to familiarize yourself with all aspects of the DocMR platform. We will grant you access to your account immediately following the conclusion of the training session.
3. d. Billing and Renewal:
We accept payments in US Dollars or Euros, either in cash or online. DocMR is not responsible for any additional charges (bank fees, transfer fees or finance changes).
We will not automatically renew your monthly or yearly subscription. Prior to the expiration of your subscription, we will reach out via email to inquire about your interest in renewing your subscription and provide details regarding the renewal cost in case it has changed.
3. e. Fee Adjustments:
DocMR reserves the right to change the pricing packages at any time with no prior notice. In the event that DocMR changes the pricing of any or all of its packages, these modifications will come into effect during the subsequent subscription cycle. Any alterations to pricing packages will be transparently communicated on our website (www.docmr.net). Subscribers will be notified of any changes in pricing, retaining the right not to renew their subscription should they disagree with the adjustments.
3. f. Additional Customizations
Our standard packages described on our Website are provided with predefined features and specifications. However, we understand that customers may have unique requirements or preferences that necessitate additional customization beyond what is offered. Any additional customization requests may be accommodated, subject to our approval and terms. Depending on the nature of the customizations, they might incur additional charges that will be transparently discussed with the client. Our team will only start applying customizations to your account after your payment has been successfully processed.
4. Cancellation, Termination and Refund Procedures:
4. a. Subscription Cancellation:
You retain the ability to cancel your monthly or yearly subscription at any point by contacting us via email at info@docmr.net. The cancellation will become effective at the conclusion of your current subscription term. In case you have chosen to subscribe to the yearly plan and cancel before the subscription ends, you will not receive a partial refund for the remaining months.
4. b. Subscription Termination:
DocMR retains the right to terminate your subscription at any time in case you have violated your rights as a registered user by not following the user guidelines. In this case, no refund will be provided.
4. c. Refund Policy:
To qualify for a refund, you must notify us within one month of your purchase, and our team will proceed with processing your refund. Refunds will be issued to the original payment method used for the purchase and will be processed within 10 to 30 days. Transfer fees are not included in the refund amount.
Refunds are not applicable in the following situations:
- If you ask for a refund after one month from the date of purchase
- If you fail to comply with these Terms and Conditions or our User Guidelines
- If you cancel a yearly subscription prior to the end of the subscription period and ask for a partial refund
5. Customer Support
We have a dedicated support team that is ready to answer all your questions by phone, email or video call. Customer support is included within your monthly or yearly subscription, and will not incur any additional charges.
6. Maintenance:
The registered user agrees that DocMR may install software updates, error corrections, and software upgrades to the Services as we deem necessary from time to time. All such updates, error corrections and upgrades will be considered part of the Services for purposes of this agreement.
7. Privacy Policy:
We care about data privacy and security. By using the Services provided by DocMR, you agree to be bound by our Privacy Policy posted on our website. Please be advised the Services provided by DocMR are only intended for users who have patients in Lebanon. If you input patient data from any other region of the world with laws or other requirements governing personal data collection, use, or disclosure that differ from applicable laws in Lebanon, then you are doing so on your own initiative and you are solely responsible for compliance with local laws, if and to the extent local laws are applicable.
8. Force Majeure
Neither party will be held responsible for any failure or delay in fulfilling its obligations under these terms due to circumstances beyond their reasonable control, including but not limited to power outages, Internet service provider failures, riots, rebellions, war, fires, floods, earthquakes, explosions, and other natural disasters.
DocMR cannot guarantee real-time communication and therefore should not be held liable for any disruptions in network connectivity, such as loss or delay of data transmission.
9. Disclaimer
The Services provided by DocMR are offered on an as-is and as-available basis, with users agreeing that their use of the services is at their sole risk. DocMR disclaims all warranties, expressed or implied, regarding the services and their use. DocMR makes no warranties or representations about the accuracy or completeness of the services' content or linked websites and mobile applications. DocMR will not be liable for errors, personal injury, unauthorized access, interruptions, viruses, or any loss or damage resulting from the use of the services. DocMR does not endorse or assume responsibility for any third-party products or services advertised or offered through the services. Users are advised to exercise caution and use their best judgment when engaging in transactions with third-party providers.
10. Limitation of Liability:
IN NO EVENT WILL DOCMR BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY DIRECT, INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFIT, LOST REVENUE, LOSS OF DATA, OR OTHER DAMAGES ARISING FROM YOUR USE OF THE SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. NOTWITHSTANDING ANYTHING TO THE CONTRARY CONTAINED HEREIN, OUR LIABILITY TO YOU FOR ANY CAUSE WHATSOEVER AND REGARDLESS OF THE FORM OF THE ACTION, WILL AT ALL TIMES BE LIMITED TO THE LESSER OF THE AMOUNT PAID, IF ANY, BY YOU TO US DURING THE three (3) MONTH PERIOD PRIOR TO ANY CAUSE OF ACTION ARISING.
11. Dispute Resolution:
Any dispute or claim arising out of or in connection to this Agreement will be governed by the French laws. Any dispute will first be resolved by both parties through informal negotiation. In case no resolution can be reached through informal negotiation, such dispute may be referred to the French Courts.
12. Future Modifications To The Terms And Conditions
DocMR reserves the right to modify these Terms and Conditions at its discretion. Such modifications may involve additions, deletions or content alterations. These modifications will come into effect upon their posting on our Website (www.docmr.net). It is your responsibility to routinely review the Terms and Conditions for any alterations. By continuing to access the DocMR Website or to utilize the Services provided by DocMR after the effective date of any changes, you consent to be bound by the revised terms. If you disagree with any amendments, your only option is to discontinue using the Services provided by DocMR or refrain from accessing the Website. The most current version of the Terms shall govern and supersede all previous versions.
